Terms of Service

These Terms of Service ("Terms") govern your use of Notibase — the messaging infrastructure platform available at notibase.com, api.notibase.com and through our SDKs and APIs (the "Service"), operated by Notibase ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Notibase provides developer infrastructure for sending notifications and messages — web and mobile push, in-app messaging, audience management, attribution and related analytics. We deliver messages through third-party platform services (such as Apple Push Notification service, Firebase Cloud Messaging and browser push services) using credentials you provide; final delivery is subject to those platforms.

2. Accounts & acceptable use

You are responsible for activity under your account and for keeping server keys and credentials confidential. You agree not to use the Service to send spam or unlawful, deceptive or harmful content; to violate the platform policies of Apple, Google or browser vendors; to infringe others' rights; or to probe, disrupt or overload the Service. You must have a lawful basis (such as consent) for messaging your end users. We may suspend accounts that endanger the platform or other customers, and will tell you why.

3. Your content & data

You retain all rights to the content you send and the end-user data you submit. You grant us the limited rights needed to operate the Service — storing, processing and transmitting that data to deliver your messages and show you analytics. We process end-user data as your processor, as described in our Privacy Policy. We do not sell your data or use your content to advertise to anyone.

4. Plans, billing & changes

Paid plans are billed monthly through Stripe and renew automatically until cancelled; you can cancel or change plans at any time in the dashboard and cancellation takes effect at the end of the billing period. Plan limits are enforced by the Service and described on the pricing page. We may change prices or plan limits with at least 30 days' notice; changes never apply retroactively to a period you have already paid for.

5. Service availability

We operate the Service with redundancy, monitoring, tested backups and documented recovery procedures, and we target continuous availability, but the Service is provided without a guaranteed uptime level unless separately agreed in writing. We schedule maintenance to minimise disruption where practical.

6. Intellectual property

The Service, including its software, design and documentation, is our property or that of our licensors. Our open-source SDKs are licensed under the MIT license included with each package. These Terms grant you no rights to our trademarks.

7. Disclaimers & liability

The Service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties and our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect or consequential damages, or for failures of third-party delivery platforms. Nothing in these Terms limits liability that cannot lawfully be limited.

8. Termination

You may stop using the Service and delete your account at any time. We may terminate accounts for material breach of these Terms after notice where practical. On termination we will, on request, make your exportable data available for a reasonable period before deletion.

9. Changes to these Terms

We may update these Terms; material changes will be announced by email or in the dashboard at least 14 days before they take effect. Continued use after that date constitutes acceptance.
